Terms, Conditions, and All Your Questions Answered

General Terms of Use
- Work I provide is intended for personal use only. This means you can use them for things like icons, twitter banners, printing them out to hang them on your wall, etc., but you may NOT use them in any situation where their use will result in the gain of real or fake currency, eg merchandise, marketing, etc.
- By commissioning me, you’re purchasing my artist labor only. I retain all copyrights over my work, which include but are not limited to the right to distribute, reproduce, or use the image as a sample for sales/self-promotion, unless otherwise agreed upon. Commercial usage rights are not available at this time.
- If you commission me for fanart (where fanart is defined as works based on major commercial properties), be aware I reserve the right to use the works created in merchandise as I see fit. I will never sell merchandise of commissions of original characters without making significant edits to remove the likeness of your character.
- If you have a desired deadline, you must include this explicitly in your initial email; vague deadlines or deadlines requested after the initial email may not be honored. There may be extra charges for tight deadlines/rush delivery.
- All work may be posted on my gallery and/or social media sites as I see fit. If you wish for your commission to remain private, please inform me in your initial email.
- Any terms & conditions presented by the customer must concede to my own where applicable.
- I reserve the right to reject commissions for any reason. I am not required to state my reasons when rejecting a commission.
- I reserve the right to re-use rejected sketches as I see fit, including, but not limited to pre-posed sales and options for other customers. Appropriate modifications will be made to re-used rejected sketches, and the likeness of your character will never be offered to other parties.
- All work is presented in an exclusively digital format. No physical editions will be provided.
Payment Policy
- Payment is collected in full up front. For orders over 100$, I may be willing to split payment in half, with half up front and half at the sketch approval stage. Please inform me in your initial order if you are interested in such a payment plan. I collect payment through a Paypal invoice.
- You will receive a sketch for approval (unless it's a sketch commission--see below), at which point you may request changes. Your first round of sketch changes is free; changes made after that may require additional fees. Changes made after your approval of the sketch may require additional fees. Changes that mark a departure from the material originally agreed upon may require additional fees.
- I reserve the right to artistic freedom. My work is provided as a personal interpretation of your reference material; I am glad to work to achieve your vision, but excessive nitpicking will not be tolerated and may invoke additional fees or outright cancellation.
- I require at least one image reference. I will not work from text-only. In addition, all reference material must be presented up front in your initial form submission. Mistakes made due to missing or incorrect information are considered the fault of the buyer and are not acceptable grounds for a refund.
Refund Policy
- If you wish to cancel, you will be refunded in part based on how much work I have completed at that time.
- If I decide that I will not be able to finish your work, you will be refunded in full.
- You cannot be refunded for finished work.
Sketch Commission Terms
- Sketch commissions are provided as-is, without approval stages. Only minor changes will be made for free. A new pose constitutes a new sketch commission.
- You are permitted to have sketch or any uncolored (including lineart-only) commissions lined, colored, or in any way completed by other parties, including yourself. In these cases, my signature/watermark must be left intact, and the new finished work still may not be used for commercial gain as outlined under General Terms of Use.
Adoptable Terms
Reselling & Trading:
General:
- Adoptables may be re-sold, traded, or given away for free.
- An adoptable once sold, traded, or given away is no longer yours. You may not reverse the sale/trade if the other party does not agree, and you may not continue to treat the character as if you own it. This includes making clones of the original adoptable.
- The new owner of the adoptable must still follow these rules. Please link the new owner these guidelines!
General:
- No commercial gain may be made from any adoptable, including the sale of adoptables or adoptable species based on my original design, and not including the wholesale of the single adoptable itself as detailed in the above section. I do not offer commercial rights at this time.
- If you cancel an adoptable commission I reserve the right to sell part or all of the design as I see fit.
- I reserve the right to use off-base sketches to create a new base if I see fit.
- Adoptables are provided as-is. Only minor changes will be made for free.
- Modifying the artwork file/s I provide is prohibited.
- If you use my designs in any form of child porn/implied child porn/lolicon/shotacon (etc.) context, you will be blacklisted and I reserve the right to revoke your ownership of the design and resell/regift as I see fit.
- I must be credited as the adoptable's designer when you post the artwork file I provide anywhere online. Toyhou.se users can credit me on-site as abakkus when uploading their design. Anywhere else, please link to/tag my Twitter, Instagram, Tumblr, Deviantart, or Furaffinity, all of which are @helloabakkus.
